EEOC files lawsuit in Asheville against freight management company, alleging it refused to hire non-Hispanics

Shelby, North Carolina—The U.S. Equal Employment Opportunity Commission (EEOC) http://www.eeoc.gov/ filed a lawsuit against Propak Logistics Inc., a nationwide freight management company based in Forth Smith, Arkansas. The discrimination lawsuit alleges the freight company violated federal laws and regulations by refusing to hire non-Hispanic workers to work in non-management positions, as reported by Occupational Health and Safety.

The EEOC states Propak Logistics had unlawful employment practices from October 1, 2002 through June 30, 2004, by refusing to employ workers who were not of Hispanic origin for non-management positions. Propak allegedly hired a majority of Latinos instead of equally or more qualified non-Latino workers to work at its Shelby, North Carolina facility. The freight company violated the Title VII of the Civil Rights Act of 1964 by engaging the unlawful hiring practices. The EEOC reportedly tried to reach a voluntary settlement with Propak before filing the discrimination lawsuit in the U.S. District Court for the Western District of North Carolina, Asheville division. The EEOC and Propak Logistics were not able to reach a voluntary agreement, forcing the EEOC to file the lawsuit. The EEOC is asking for back pay for the discriminated victims, in addition to compensatory and punitive damages and injunctive relief.
