Clarke Morrison of the Asheville Citizen-Times reports:

A judge ordered a prominent downtown restaurant owner to complete anger management classes and perform community service for striking a city parking services worker in the head.

Hector Diaz was found guilty in Buncombe County District Court of misdemeanor assault on a female, District Attorney Ron Moore said.

Judge Julie Kepple sentenced Diaz earlier this month to 60 days in jail and suspended the sentence for 12 months.

In addition to the anger management classes, as conditions of his suspended sentence Diaz must perform 72 hours of community service, pay a $200 fine, obtain a mental health evaluation and follow all treatment recommendations.

Background on Diaz and his clash with the parking attendant here.

First time offenders often get anger management and probation and their convictions expunged if they behave. Someone with a good lawyer and connections could probably get away with that twice. No telling what happened with the first two.

He may have been charged, but that doesn’t mean he was convicted.

A search of the NC Offenders website, in fact, only reveals a conviction that resulted in his NCDL being revoked in 2005.

How do you know that information references this Hector Diaz? There are many Hector Diaz’s in North Carolina, and the one you’re referencing here was in Chatham County and appears to be of a different age. In short, Murphy, this appears to be another person.

WLOS reported that this is Diaz’ THIIRD assault charge. If so, he should have been ordered to jail AND anger management classes. He’s a little worm and one day he’s going to assault the wrong person who’s going to squash him like the pest he is.
